What Is A Legal Document Preparer

A Legal Document Preparer is a non-lawyer who assists individuals in preparing legal documents for a variety of needs at a lower cost than an attorney.

Legal Document Preparers can help with a variety of legal documents, including those related to family law, simple (uncontested) divorce, business formation.

It’s important to note that while Legal Document Preparers can assist with the preparation of legal documents, they cannot provide legal advice or represent you in court. If you have complex legal issues or require legal advice, it is recommended to consult an attorney.

How Can A Legal Document Preparer Help You?

There are several reasons why you might choose to use a Legal Document Preparer:

☑️ Cost-effective/Affordability: Legal Document Preparers often charge lower fees than attorneys for similar services, making them a more affordable option for those with limited budgets.

☑️ Knowledge: Legal Document Preparers are experienced in preparing legal documents, ensuring that they are completed accurately and in compliance with relevant laws and regulations.

☑️ Convenience: Using a Legal Document Preparer can save you time and effort, as they can handle the preparation and filing of documents on your behalf.

☑️ Limited Scope Representation: In some cases, you may only need assistance with preparing legal documents and not full legal representation. A Legal Document Preparer can provide this limited scope representation.

Our Services

Family Law

Family law is a legal practice area that deals with legal issues related to family relationships and domestic matters. It encompasses a wide range of topics and issues that affect families, couples, and children.

While some people choose to prepare these documents themselves using online templates or guides, others prefer to seek assistance from legal document preparers to ensure accuracy and compliance with relevant laws and procedures.

The Document Store can help with the preparation and filing of family law documents based on the information provided by the client in some common areas that include:

☑️ Simple Divorce – Often referred to as an uncontested divorce, it’s a divorce in which both parties agree on all key issues, such as the division of assets and debts, child custody and support, and alimony. In a simple divorce, the couple typically prepares and files the necessary paperwork themselves or with the help of a legal document preparer. If there are no complicating factors or disputes, the divorce can be finalized relatively quickly and without the need for a lengthy court process.

☑️ Legal Separation – A legal process through which a married couple can formalize a separation without actually getting divorced. While the couple remains legally married, they can address issues such as division of assets and debts, spousal support, child custody, and child support. Legal separation can be an alternative to divorce for couples who wish to live separately but want to retain certain legal benefits of marriage, such as access to healthcare benefits or tax advantages.

☑️ Child Custody Agreement – A legal document that outlines the terms and conditions regarding the custody and care of a child or children following a divorce or separation. The agreement typically covers important aspects such as Physical and Legal Custody, Visitation, Child Support: and Communication. Child custody agreements can be negotiated between the parents and submitted to the court for approval, or they can be established through mediation or litigation. The best interests of the child are the primary consideration in determining custody arrangements.

☑️ Child Support – A legal obligation in which a non-custodial parent is required to provide financial support for their child or children. The amount of child support is typically determined by state guidelines and takes into account factors such as the income of both parents, the number of children, and the custody arrangement.

☑️ Child Support Modification – A process through which either parent can request a change to the existing child support order. This change may be necessary due to a significant change in circumstances since the original order was issued. Common reasons for requesting a modification include:

  • Change in income
  • Change in custody arrangement
  • Change in child’s needs
  • Change in state guidelines

Simple Divorce (uncontested)

Simple divorce (uncontested) refers to a straightforward and uncomplicated legal process for ending a marriage. This type of divorce is typically chosen when both spouses are in mutual agreement on major issues such as property division, child custody, and spousal support. The emphasis is on a quick and cost-effective dissolution, avoiding prolonged legal battles. Simple divorces often involve streamlined procedures, clear communication, and minimal court involvement, making the overall process less complex for the parties involved.

The Document Store can navigate the process for couples seeking an amicable divorce. We ensure a swift and efficient process, minimizing complexity and stress for our clients.

Power of Attorney

A power of attorney (POA) is a legal document that allows one person (the “principal”) to appoint another person or organization to act on their behalf as their agent or attorney-in-fact. The agent can be given broad or limited authority to make decisions and take actions on behalf of the principal, depending on the terms of the POA.

There are several types of powers of attorney, including:

☑️ General Power of Attorney: Gives the agent broad authority to make financial, legal, and business decisions on behalf of the principal. This type of POA is often used when the principal is unavailable or unable to handle their affairs.

☑️ Limited or Special Power of Attorney: Limits the agent’s authority to specific actions or transactions, such as selling property or managing investments. This type of POA is often used for specific, one-time transactions.

☑️ Durable Power of Attorney: Remains in effect even if the principal becomes incapacitated or unable to make decisions. This type of POA is often used to plan for potential future incapacity.

☑️ Medical Power of Attorney: Also known as a healthcare proxy or healthcare power of attorney, this document appoints an agent to make healthcare decisions on behalf of the principal if they are unable to do so.

Powers of attorney can be an important tool for managing affairs and ensuring that decisions can be made on behalf of the principal if they become incapacitated or unavailable.

The Document Store can draft and customize a Power of Attorney to meet the specific needs of your situation.

Business Entity Formation

Business formation refers to the process of legally creating a new business entity. There are several common types of business entities, each with its own legal and tax implications. Some of the most common forms of business entities include:

☑️ Sole proprietorship: A business owned and operated by one person. It is the simplest form of business entity and does not require formal registration.

☑️ Corporation: A legal entity that is separate from its owners (shareholders). Corporations can raise capital by selling shares of stock and are subject to more complex regulatory and tax requirements.

☑️ Limited Liability Company (LLC): A hybrid legal entity that combines the limited liability protection of a corporation with the flexibility and tax benefits of a partnership.

☑️ Non-Profit Organization (501c 3): A type of organization that does not distribute its surplus funds to owners or shareholders but instead uses them to pursue its goals. Nonprofits are typically dedicated to furthering a particular social cause or advocating for a particular point of view.

The Document Store can prepare documents to legally establish your business – once you chose, we do the work. Working with our professionals is seamless, making this journey easier for you!
